The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379 and 504/34 of the Indian Penal Code. Prosecution case is that while the petitioner assaulted upon the father of the informant, he came to his rescue, he was also assaulted by the other accused persons and looking this, the wife of the informant came to save him, she was also assaulted by the other accused persons as well as snatched her gold chain. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the injuries are simple in nature as is evident from Annexure-2 to the supplementary affidavit filed by
Patna High Court CR. MISC. No.16603 of 2022(2) dt.20-09-2022 2/2 the petitioner. Petitioner has clean antecedent. Learned APP appearing for the State opposed the anticipatory bail.
Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Jamui in connection with Chandradeep P.S. Case No. 06 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
