Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 366A and 376/34 of the Indian Penal Code.
Submission is that though allegation is of kidnapping of the minor daughter of the informant, however, Annexure-2 would reveal that before the Notary Public, petitioner and the victim took oath that they have married in a temple on 29.08.2018 i.e. the date of oath and thereafter under pressure of the parents, she stated that the petitioner forcefully took her away, married with her and was in physical relation with the petitioner.
Considering the fact of this case aforesaid and completion of investigation, let the petitioner, above named, be
Patna High Court CR. MISC. No. 15067 of 2019(5) dt.15-05-2019 2/2 released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Rupaspur Police Station Case No. 376 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
