This application for grant of anticipatory bail arises out of Rohtas P.S. Case No. 29 of 2016, disclosing offences under Sections 341, 323, 324, 354 (A), 379, and 504/34 of the Indian Penal Code. The petitioner nos. 1 and 2 are sons, 3 and 4 daughters and 5 wife of Safee Khan @ Safique Khan who have been made accused in the said F.I.R., on the basis of written report of the informant Safique Ahmad.
Learned Senior Counsel appearing on behalf of the petitioners referring to the First Information Report, has submitted that
Patna High Court Cr.Misc. No.18886 of 2016 (2) dt.06-05-2016 2/2 there is property dispute between the families of the informant and the present petitioner. FIRs have been registered by the informant of the present case and the other by Md. Safique Khan, relating to same occurrence.
It is further, submitted that no purpose would be served if the petitioners are taken into custody in view of the nature of accusation.
Considering the submission as above this application is allowed.
Let the petitioners, above-named, in the event of their arrest/surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M, Dehri, Rohtas in Rohtas P.S. Case No. 29 of 2016, subject to the conditons as laid down under Section 438(2) of the Cr.P.C.
This is subject to the condition that the petitioners shall present themselves before the police/court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutives occasions, their bail bonds shall be liable to be cancelled.
