2. Mina Devi, wife of late Ramnath Choudahry, resident of villageKukurbhuka, P.S.- Mirganj and District- Gopalganj. .... .... Opposite Party/s ====================================================== Appearance :
For the Petitioner/s : Mr. Anirudh Kumar Verma For the Opposite Party/s : Mr. Ram Chandra Sahni (App) ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 21-08-2017 Heard learned counsel for the parties.
Petitioner has challenged the cognizance order dated 11.10.2012 as well as revisional order dated 07.05.2014 passed by Additional District and Sessions Judge, Gopalganj whereby order taking cognizance was upheld.
Submission is that the petitioner's wife is the owner of the vehicle and not the petitioner.
It appears that charge sheet has been submitted against the petitioner considering material collected in investigation finding him driver of the vehicle and the report of the trial court shows that the case is fixed for evidence, so on this account also this matter has become infructuous. Accordingly, it is dismissed as such. (Arun Kumar, J) Sujit/- U
