JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-09-2017 Heard learned counsel for the petitioner and the State. This application has been filed for grant of regular bail in connection with Saraiya P.S. (Jaitpur O.P. 18/34), Sessions Trial No. 516 of 2014 for an offence under section 302/34 of the Indian Penal Code.
The occurrence is dated 5.2.2013.The petitioner is in custody since 31.1.2014.
Counsel for the petitioner submits that trial has commenced and most of the witnesses have been examined except the doctor and the I.O.
In view of the fact that petition for grant of bail of other similarly circumstanced co-accused Jatahu Mahto was dismissed vide order dated 26.7.2017, this court is not inclined to grant bail to this petitioner. However, considering the fact that trial
