The petitioner seeks bail in a case registered under Sections 363, 366A/34 of the Indian Penal Code. The prosecution case in brief is that the informant's grand daughter was kidnapped by the accused persons. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 27-10-2018. Charge sheet has already been submitted. The petitioner has been falsely implicated in the present case. The victim girl has been examined under Section 164 Cr.P.C. in which, she has not made allegation of sexual or physical assault against the petitioner.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Miss Priti Kumari, learned Judicial Magistrate-Ist Class, Muzaffarpur in connection with Deoriya P.S. Case No. 151 of 2018.
