The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 467, 468, 471, 420, 414/34 of the Indian Penal Code.

The prosecution case in nutshell is that during patrolling police stopped two persons namely Ramakant Ray @ Sukho ray and Rupesh Kumar Jha with stolen motorcycle. On further inquiry Ramakant Ray disclosed that he had bought the bike in question from the petitioner and he has also helped in preparing duplicate documents.

No.16616 of 2022(3) dt.02-01-2023 2/3 It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. It is also submitted that petitioner is languishing in judicial custody since 2406-2021. It is further submitted that name of petitioner sprang up in this case on the basis of confessional statement of co-accused persons, namely, Ramakant Ray @ Sukho Ray. The petitioner has no concern with the motorcycle in question. Neither he is owner of the said motorcycle nor he has sell the said motorcycle and manufactured the forged documents. From perusal of the Annexure 2 of this application, it appears that the vehicle in question belongs to Pankaj Kumar.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on
