This is an application for bail in connection with Gwalpara (Arar O.P.) P.S. Case No. 1 of 2015 registered for the offences punishable under Section 392 of the Indian Penal Code. Allegation against the petitioner is of snatching of bag containing purse, ATM cards, papers, etc. from the informant. Submission of learned counsel for the petitioner is that no recovery has been made from his possession and no Test Identification Parade was held and he has falsely been implicated in this case. Further submission is that though he has been made accused in other cases but he is on bail in those cases and he is in custody in the present case since 19.5.2015.

Heard learned APP also, who has opposed the prayer for bail.

No.37040 of 2017 (3) dt.04-09-2017 2/2 Having heard both sides and in view of facts and circumstances and also considering the period of custody, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Udakishunganj, District Madhepura, in connection with Gwalpara (Arar O.P.) P.S. Case No. 1 of 2015, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will mark his attendance in the local police station in first week of every month till conclusion of trial, failing which prosecution will be at liberty to move cancellation of his bail bond.
