JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 302, 201 of the Indian Penal Code.

On recovery of a dead body, FIR was registered against unknown.

Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has transpired in this case during the course of investigation. Only material that has come against this petitioner that he being a saint also used to live with the deceased and except that there is no material against this petitioner to show his involvement in the alleged occurrence. Petitioner has got clean antecedent. Learned counsel appearing for the State opposes the

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-V, Begusarai in connection with Bakhari PS case No. 26/ 2016, subject to conditions laid down u/s 438(2) of the Cr.P.C.
