JUSTICE MOHIT KUMAR SHAH ORAL ORDER 31-05-2018 Heard the learned counsel for the petitioner and the learned APP for the State.
The petitioner seeks regular bail in connection with Aurangabad Town PS case no. 97 of 2018 instituted for the offences punishable under Sections 307 and other allied sections of Indian Penal Code.
The prosecution case, as lodged by the informant, is that during Ramnavami procession, while the procession crossed the Muslim Muhalla, there was stone pelting and brick batting and in various other places, there was incident of firing and as many as 124 persons including the petitioner have been named in the FIR who were identified by CCTV footage.

No.31618 of 2018 (2) dt.31-05-2018 2/2 The learned counsel for the petitioner submits that the petitioner is innocent, has no criminal antecedent and no overt act has been alleged to have been committed by him as it was a communal clash and mob attack and large number of cases have been filed on the same day against many persons. It is further submitted that some of the accused, named in the FIR, have been granted privilege of pre-arrest bail by this Court and the petitioner is languishing in custody since 23.04.2018.
Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Town) PS case no. 97 of 2018.
