The sole petitioner, who is in custody since 05.06.2017 in Nasriganj P.S. Case No.103/2017 registered for the offence under Section-30(A) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.

By way of referring to the statement made in paragraph-3 of the petition, learned counsel for the petitioner submits that the petitioner is having clean antecedent and languishing in jail custody since long. Though the petitioner was not apprehended at the place of occurrence, it was alleged that he was identified while fleeing away. She submits that from a Bolero

Patna High Court Cr.Misc. No.39492 of 2017 (2) dt.19-08-2017 2/2 vehicle, huge quantity of country-made liquor was recovered and besides country made liquor, a driving licence of the petitioner was found in the vehicle.

However, considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner, namely, Sudhir Kumar Rai@ Kush Rai @ Sudhir Kumar be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned A.S.J.-II-cum- Special Judge (Excise), Rohtas in connection with Nasriganj P.S. Case No.103/2017.
