2. The present writ petition has been filed for a direction to the respondent authorities to appoint the petitioner to the post of Anganwari Sahayika under Nawanagar Pariyojna, and also to declare the appointment of respondent No. 5 as null and void.

3. Learned counsel for the petitioner submits that respondent No. 6 has obtained appointment on the basis of forged and fabricated documents.

4. Learned counsel for the State submits that although the petitioner has filed the present writ petition, he has not challenged the order passed by the District Programme Officer, Buxar. It is further submitted that the petitioner has a statutory remedy of appeal, but has approached this Hon'ble Court directly without availing the said remedy.

5. Accordingly, the present writ petition stands disposed of with liberty to the petitioner to prefer an appeal before the appropriate authority.

6. It is made clear that the appellate authority shall pass an order on the appeal, if preferred, within 90 days from the date of completion of appearance of the parties, after affording an opportunity of hearing to all concerned parties. (Dr. Anshuman, J) Ashwini/- U
