Petitioner, already in custody, seeks bail in connection with Manjhi P.S. Case No.265 of 2016 (S.T. No.585 of 2017) registered under Section 376 of the Indian Penal Code. Allegation in brief is that in the night after scaling the wall of the house of the informant, the petitioner was committing rape, in the meanwhile, her mother woke up and he was apprehended there and it is alleged that for last 11⁄2 years the petitioner was in physical relationship with the prosecutrix on the pretext of getting married with her.

Learned counsel for the petitioner submits that the girl is major, she herself states her age 18 years and was consenting

Having considered the aforesaid facts and circumstances, petitioner Sahnawaj Ansari @ Shahnawaj Ansari is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th A.D.J., Saran in connection with Manjhi P.S. Case No.265 of 2016 (S.T. No.585 of 2017). (Arun Kumar, J) S.KUMAR/- U T
