The petitioner seeks bail in a case instituted for the offences under Section 147, 148, 149, 341, 323, 354(A), 385, 504, 506, 509 of the Indian Penal Code and 30(c) of the Bihar Prohibition and Excise Act, 2016.

Prosecution case, in short, is that the accused person in drunken state misbehaved and created chaos in the orchestra party.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.1.2020. There is no allegation of tampering of witnesses alleged against the petitioner. The allegation is that the petitioner misbehaved in the orchestra in drunken state. There is no recovery of liquor from

On behalf of the State, it is submitted that the petitioner is named in the F.I.R/complaint case. Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna in connection with Special Case No. 11195/18 arising out of Agamkuan P.S. Case No. 941/18.
