The petitioner seeks regular bail in connection with Rajapakar P.S. Case No. 42 of 2018 for the offences punishable under Section(s) 30 (A) of the Bihar Excise Prohibition of Liquor Act, 2016.
The allegation is regarding recovery of 40 liters of illicit liquor from the tube of truck.
The learned counsel for the petitioner submits that the petitioner is innocent and in fact no recovery has been made from the conscious possession of the petitioner. It is further submitted that the petitioner has in fact been remanded in the present case when he was arrested in one another case lodged after registration of the present case. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, II-cum-Special Judge, Vaishali, Hazipur, in connection with Rajapakar P.S.
