The petitioner seeks regular bail in connection with Kudhani P.S. Case No. 22 of 2017 for the offences punishable under Section 395 of Indian Penal Code.

The allegation is regarding unknown miscreants having looted money from the informant after apprehending him. The learned counsel for the petitioner submits that two cases were lodged for the same incident, one bearing Ramgarh (Nuaon) P.S. Case No. 313 of 2017 and the other one is the present case. It is further submitted that other than the statement of the co-accused person, there is nothing to implicate the petitioner in the present case. It is further submitted that as far as the petitioner is concerned, no recovery has been made from his

Patna High Court Cr.Misc. No.31789 of 2018 (2) dt.31-05-2018 2/2 conscious possession or from his house and the T.I. Parade has not been held till date. It is further submitted that barring the aforesaid Ramgarh (Nuaon) P.S. Case No. 313 of 2017, the petitioner is having a clean antecedent and is languishing in custody since 24.01.2018. It is further submitted that similarly situated coaccused person has already been granted bail by this Court vide order dated 05.04.2018 passed in Cr. Misc. No. 12425 of 2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - IIIrd, Kaimur at Bhabua in connection with Kudhani P.S. Case No. 22 of 2017.
