Heard learned counsel for the petitioner and learned APP for the State.
The petitioner seeks bail in a case registered for the offence punishable under Sections 304b/34 of the Indian Penal Code.
As per the prosecution case, petitioner in association of his family members committed the murder of his wife on non-fulfillment of dowry demand.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in
Patna High Court CR. MISC. No.13709 of 2020(4) dt.01-07-2020 2/2 nature. There is no eye witness of the occurrence. As a matter of fact, the deceased committed suicide. The petitioner has no criminal antecedent and has been languishing in custody since 10.05.2019.
Learned APP for the State opposing the bail petition submitted that there is serious allegation against the petitioner of committing murder of his wife, hence, he does not deserve bail.
In the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. The prayer for bail is hereby rejected.
