JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-05-2016 Petitioner being co-villager of the husband of the victim is apprehending his arrest in a case registered for the offences punishable under Sections 498A, 302/34 of the Indian Penal Code.

The prosecution case is of killing the daughter of the informant after about nine years of marriage. It is submitted by learned counsel for the petitioner that only on suspicion the petitioner has been roped in the present case. On conclusion of the investigation the final form was submitted as the case was not found true but differing with the final form learned Magistrate took cognizance. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.19612 of 2016 (2) dt.03-05-2016 2/2 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Siswan P.S. Case No. 140 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
