ANJANA MISHRA ORAL ORDER 28-06-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 05.06.2017 in connection with S.T. No.410 of 2017 arising out of Sono (Charka Pathar) P.S. Case No.115 of 2017 registered for the offence under Sections 147, 148, 149, 120B, 121A of the Indian Penal Code and Section 3/4 Explosive Substances Act and Sections 16, 17, 18, 19, 20, 21, 22 of the UAP Act. Learned counsel for the petitioner submits that only on the basis of suspicion, the petitioner has been taken into custody and his L.T.I. has been taken on a piece of paper which has been used as his confessional statement by the police, which has got no evidentiary value. It is further submitted that there is

No.31933 of 2018 (3) dt.28-06-2018 2/2 no recovery from the possession of the petitioner and the allegation that he was engaged in manufacturing bomb is wholly frivolous and he has nothing to do with the seized articles. It is further submitted that the petitioner is also having no criminal antecedents.

Considering the aforementioned facts and circumstances and that the petitioner has been in custody for more than a year, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 1st, Jamui, in connection with S.T. No.410 of 2017 arising out of Sono (Charka Pathar) P.S. Case No.115 of 2017.
