The petitioner is apprehending his arrest in Rajeev Nagar P.S. Case No. 09 of 2013 registered under sections147, 323, 341, 353, 504, 505, 506 of the Indian Penal Code and 3⁄4 of Damage of Public Properties Act. According to the first information report given before the SHO, Rajeev Nagar P.S. on 17.01.2013 , it has been alleged that several persons were helping the work of illegal construction on the acquired land of Bihar State Housing Board for which people of the locality creating obstruction on the road. It has been submitted on behalf of the petitioner that altogether 21 persons have been named in the first

Patna High Court Cr.Misc. No.23594 of 2015 (2) dt.06-07-2015 2/2 information report. It is further submitted that the name of the petitioner has appeared in the present case due to mistake of fact. The petitioner has no concerned with the present occurrence. It is further submitted that the petitioner has no criminal antecedent. On behalf of the State it is submitted that the petitioner is named in the first information report. Considering the aforesaid facts and circumstances of the case, the above named petitioner in the event of his arrest or surrender before the court below within a period of four week from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in Rajeev Nagar P.S. Case No. 09 of 2013, subject to the conditions laid down under section 438(2) Cr.P.C.
