JUSTICE RAKESH KUMAR ORAL ORDER 15-09-2017 Heard Sri Arun, learned counsel for the petitioner and Dr. Kumar Uday Pratap, learned Additional Public Prosecutor. The sole petitioner, who is in custody since 24.05.2017 in S.T. Excise Case No. 299 of 2017 [arising out of Kunauli P.S. Case No. 20 of 2017] registered for the offence under Section 30(A) of the Bihar Prohibition And Excise Act , 2016 has prayed for grant of bail.

Learned counsel for the petitioner by way of referring to statement made in paragraph no. 3 of the petition submits that petitioner is having clean antecedent and petitioner has falsely been apprehended on accusation as if petitioner was involved in carrying about 133 liter of Nepali country made liquor. Considering the nature of accusation, clean antecedent of the petitioner as well as period of custody, let the petitioner
