JUSTICE SUDHIR SINGH ORAL ORDER 23-07-2015 The petitioner is apprehending his arrest in Complaint Case No.2617C/13 for the offences under Section 498A of the I.P.C. and 4 of the Dowry Prohibition Act. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution story, in short, is that on 29.5.2012 the marriage of the complainant was solemnized with the petitioner while he was pursuing his study in M.S. After some time all the accused persons including the petitioner demanded dowry and on account of non-fulfillment of their demand they started torturing her and even threatened to kill her.

No.28731 of 2015 (2) dt.23-07-2015 2/2 On behalf of the petitioner it has been submitted that the petitioner is ready to keep the complainant but for certain reason the matter is not settled between the parties though an effort was made by the learned Sessions Judge also in this regard. It is further submitted that the petitioner is ready to deposit Rs.4000/- per month in the court below which shall be released in favour of the complainant.
On behalf of the State it is submitted that the petitioner is named in the F.I.R. who is husband of the complainant.
Considering the aforesaid facts and circumstances, petitioner is directed to deposit Rs.4000/- per month in the court below in favour of the complainant and on his doing so, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of S.D.J.M., Bettiah (West Champaran), in S.C.878/14 arising out of Complaint Case No.2617-C/13 subject to the conditions as laid down under Section 438(2) Cr.P.C.
