Petitioner apprehends his arrest in a case filed under Section 394 of the Indian Penal Code to which Section 411 of the I.P.C. was also added later on.

It is contended on behalf of the petitioner that F.I.R. was lodged against the unknown persons and petitioner has been implicated on the basis of disclosure of the name in the confessional statement of the co-accused Satyendra Singh. It is contended that nothing incriminating has been recovered from his possession. Only material against him is confessional statement by the co-accused, Satyendra Singh and Shani, who have been acquitted of the criminal charges vide judgment appended as

Having regards to the facts and circumstances of the case, in the event of arrest/surrender within a period of six weeks from today in Durgawati P.S. Case No.139 of 2009, the above named petitioner, Rajnish Singh shall be released on bail on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
