The petitioner apprehends his arrest in a case registered for the offence under Sections 406, 409, 420 of the Indian Penal Code.

As per the prosecution case, two F.I.R. named accused persons illegally withdrawn Rs. 13,45,594/- and Rs. 13,45,013/- respectively by committing fraud. Petitioner is not named in the F.I.R. Name of the petitioner transpired during course of investigation. Only material, which has come against the petitioner, is that on his last date of retirement, he (petitioner) signed the paper for payment of salary to F.I.R. named co-accused. It is further submitted that during departmental proceeding, no misconduct or irregularity was found against the petitioner. There is no allegation that he embezzled or committed any fraud. Patna High Court CR. MISC. No.16032 of 2022(2) dt.25-08-2022 2/2 is not the beneficiary of the alleged offence. Departmental proceeding has already been initiated against accused teachers. Petitioner has got clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as clean antecedent, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Madhepura in connection with Srinagar P.S. Case No. 16 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
