It has been submitted by the learned counsel for the petitioner that he was not informed about the earlier bail application filed by the petitioner regarding the same P.S. case, which was filed by some other lawyer and now it has come to his notice, hence, he prayed that the defect may be ignored.
Considering the fact that petitioner had earlier moved for bail, which was granted in Cr. Misc. No. 36017 of 2017 on 10.08.2017 by a coordinate Bench of this Court, no cause of action survives. The petitioner is permitted to withdraw the present application.
The application is dismissed as withdrawn.
