ANJANA MISHRA ORAL ORDER 27-04-2016 By the present modification application, the petitioner seeks modification of the order dated 11.08.2015 passed in Cr. Misc. No. 30443 of 2015 for extending the time to deposit the 20% of the alleged defalcated amount.

It is submitted that the petitioner was required to deposit around rupees three lacs eighty thousand but has been able to deposit only rupees twenty-one thousand till date. However, he is willing and ready to deposit the rest amount within a period of four months.

Considering all facts and circumstances, this Court, while taking a lenient view, is granting a further extension of four months from the date of receipt/production of a copy of this order. By the said period, the petitioner shall positively deposit the rest amount which remains of the 20% so directed to be deposited. In case, the petitioner does not deposit the same for any reason, the

Patna High Court Cr.Misc. No.17212 of 2016 (2) dt.27-04-2016 2/2 order dated 11.08.2015 shall stand automatically recalled. Other terms and conditions shall remain the same. (Anjana Mishra, J) Saif/- U T
