JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-09-2017 The petitioner seeks regular bail in connection with Mithanpura P.S. Case No. 223 of 2017, registered for offences punishable under Sections 30 of the Bihar Prohibition and Excise Act, 2016 and Section 290, 420, 379, 120-B/34, 467 and 468 of the Indian Penal Code and Section 66 of I.T. Act. Prosecution case is that police on secret information that four persons have been seen in suspicion condition, raided the place and apprehended them and several items including ATM Cards of different Banks, country made pistol and cartridges were recovered and from the possession of the petitioner two bottles of Indian made foreign liquor was recovered.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case. Moreover, he has

Patna High Court Cr.Misc. No.42271 of 2017 (3) dt.12-09-2017 sufficiently been punished for the alleged offence as he has been in judicial custody since 22.07.2017 and so far criminal antecedent is concerned, he is accused in one more case but that is not of similar nature as the present one.

Having heard both sides, considering the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge cum Special Judge, Excise Act, Muzaffarpur, in connection with Mithanpura P.S. Case No. 223 of 2017.

It is made clear that if the petitioner again found involved in any of the like offences, in future, prosecution will be free to move for cancellation of his bail bonds.
