The petitioner seeks regular bail in connection with Purnea Sadar P.S. Case No. 529/2017 for the offences punishable under Sections 147, 148, 149, 341, 323 and 302 of Indian Penal Code and Section 27 of Arms Act.

The allegation is regarding the accused persons having assaulted the brother of the informant while he was returning from market.

The learned counsel for the petitioner submits that the allegation of assault even as per the F.I.R. admittedly is against one Birendra Kumar Chaudhary. It is further submitted that as far as the petitioner is concerned, no specific allegation of overt act is leveled against him. It is further submitted that the other accused

No. 60468 of 2017 vide order dated 13.03.2018 as also by order dated 12.04.2018 passed in Cr. Misc. No. 11056 of 2018. The petitioner is stated to be languishing in custody since 13.04.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with Purnea Sadar P.S. Case No.529/2017.
