The petitioner apprehends his arrest in a case registered for the offence under Sections 376, 506/34 of the Indian Penal Code and Section 3 / 4 of the POCSO Act. As per the prosecution case, this petitioner alongwith two unknown persons kidnapped minor daughter of the informant and thereafter, committed rape upon her. The victim girl has supported the prosecution case in her statement recorded under Section 164 Cr.P.C. and has specifically named this petitioner, as one of the accused, who committed rape upon her.

Considering the statement of the victim recorded under Section 164 Cr.P.C., the prayer for anticipatory bail of petitioner is rejected.
