The petitioner apprehends his arrest in Excise Case No.179 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is further submitted that nothing has been recovered from possession of the petitioner. The alleged recovery was made from the passage which is situated at the outer side of the house. The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances of the case, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a

No.26829 of 2021(2) dt.22-02-2022 2/2 period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing personal bond to the satisfaction of learned Additional District & Sessions Judge 2nd-cum-Special Judge, Excise, Rohtas at Sasaram in connection with Excise Case No.179 of 2020, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
