Mrs.Anita Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 15-07-2020 Heard the parties through the virtual court proceeding. The petitioner apprehends his arrest in connection with Kuchaikote P.S. Case No. 291 of 2019 registered for the offences punishable under Sections 147, 149, 323, 324, 325, 307 and 504 of the Indian Penal Code.
The prosecution case, in brief, is that on the alleged date and time of occurrence, informant Munni Devi was sitting at her door along with her children. In the meantime, petitioner in association with co-accused persons variously armed came at her door and asked as to why she has given petition in P.S. against them which led to hot altercation and converted into the occurrence of Mar-pit and on the instigation of Manager Yadav, Baliram Yadav inflicted Farsa blow on her head causing

No. 16578 of 2020(2) dt.15-07-2020 2/3 bleeding head injury toher and when her son Mantu Yadav rushed to rescue her, Anurudh Yadav inflicted Farsa blow on his head, who also sustained bleeding cut injury on head and thereafter, when her another son Ranjay Kuamr Yadav rushed to rescue there, Sheshnath Yadav assaulted him on his head by iron-rod causing bleeding head injury to him. In that course, Dudhnath Yadav caused fractured injury in her right wrist and Soni Kuer assaulted Gagan Yadav by Danda.
Learned counsel for the petitioner submits that there is allegation against the petitioner that he inflicted farsa blow on his head. Learned counsel for the petitioner further submits that Anurhdh Yadav inflicted farsa blow to Mantu Yadav. The injury report, which is mentioned in Annexure-3 of the bail petition, shows that the injury is simple in nature.
Learned A.P.P. for the State has opposed the prayer for bail.
In the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of ACJM-VII, Gopalganj in connection with
