JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2017 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case registered under Sections 323, 325, 341, 342, 354, 307, 379, 511, 452, 427, 376, 511, 504 of the Indian Penal Code and 47 of Excise Act, 2016.. The allegation against the petitioners, as per FIR, is that the petitioners are dealing with the business of toddy and when the informant protested he was assaulted by petitioner nos. 2 and 3 with fists and slaps. Further allegation against petitioner nos. 1 and 3 is that they attempted to commit rape upon the wife of the informant.

Submission of the learned counsel for the petitioners is that they have falsely been implicated in this case. The petitioners

Having heard both the sides and considering the facts and circumstances of the case, let, above named petitioners, be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur, in connection with Saraiya (Jaitpur O.P.) P.S.Case No.227 of 2017, subject to the condition that one of the bailors should be a local person having sufficient immovable properties within the jurisdiction of court concerned and further condition is that the petitioners shall co-operate in trial and will appear on each and every date fixed in the case, failing which their bail bonds shall be cancelled.
