The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 460/341/323/307/395/427/354 of the Indian Penal Code and section 3(1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

It is alleged that the accused persons entered into the house of the informant assaulted the informant and her family members. The specific accusation of assault is alleged against Ilaka Singh.

It is submitted by learned counsel for the petitioner that specific accusation is not against the petitioner when injury has been found simple in nature and the occurrence took place

Patna High Court Cr.Misc. No.22536 of 2015 (2) dt.22-05-2015 2/2 inside the house of the informant, which cannot be said a place of public view.

It is submitted by learned Special PP for the State that accusation of assault is omnibus and general against all the accused persons and four persons have received simple injury. Considering the fact that the specific accusation is not against the petitioners, it is a fit case for consideration of regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Aurangabad (M) P.S. Case No. 30 of 2015, pending before the learned Chief Judicial Magistrate, Aurangabad.

With the above observation, this application is, accordingly, disposed off.
