JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-05-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the complainant is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance has been taken for the offences punishable under Sections 498A, 494, 323 and 504 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The basic accusation is of torture for non-fulfillment of the dowry demand and performing second marriage. It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the complainant and has also performed second marriage, though, the complainant has also performed second marriage. Though, the order of cognizance was passed in the year 2009 but the petitioner was not aware about such order.

No.19715 of 2016 (2) dt.16-05-2016 2/2 In the circumstance, let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Complaint Case No. 12C of 2009 pending in the court of learned CJM, Munger. Accordingly, the application is disposed of.
