This is an application for bail in connection with Kishanganj P.S. Case No. 204 of 2017 registered for the offences punishable under Sections 363, 366A of the Indian Penal Code and 4/6 of POCSO Act.
Allegation against the petitioner is of kidnapping daughter of informant and selling her for prostitution. Submission of learned counsel for the petitioner is that petitioner has falsely been implicated in this case and main allegation against co-accused and not the petitioner and he is in custody since 25.5.2017.
Heard learned APP also, who has opposed the prayer for bail stating that in her statement under Section 164 Cr.P.C. she has
Patna High Court Cr.Misc. No.40857 of 2017 (2) dt.06-09-2017 2/2 supported the prosecution case.
Having heard both sides and in view of facts and circumstances, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected.
