====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 06-04-2022 Heard learned counsel for the petitioner and learned APP for the State.

Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 363, 365, 302, 120(B)/34 of the Indian Penal Code.

The accusation is of abducting and killing the

It is submitted by learned counsel for the petitioner that there is no direct allegation against the petitioner for participating in the murder of the brother of the informant. In fact, the deceased has committed suicide since his family members were forcibly solemnizing his marriage against his will.

Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for anticipatory bail of the petitioner. He has stated that paras 34, 62 and 77 of the case diary suggests that prosecution witnesses have supported the prosecution case that this petitioner had made several calls from her mobile to the deceased even on the date of occurrence also. The postmortem report also suggests that the deceased had sustained injuries by hard and blunt substance.

Considering the facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.
