Petitioner apprehends his arrest in connection with Mohania P. S. case no. 129/2015 registered under sections 409 and 420 of the Indian Penal Code.
Petitioner happens to be mill owner and accusation against him is that he did not supply rice though he had already taken paddy from the Bihar State Food & Civil Supplies Corporation Limited. The contention on behalf of the petitioner is that several cases have been instituted against different persons and this court as well as coordinate benches of this court have granted privilege of anticipatory bail to different persons taking note of terms of agreement executed between the parties.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed
Patna High Court Cr.Misc. No.22938 of 2015 (2) dt.10-07-2015 and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua in Mohania P. S. case no. 129/2015 subject to condition as laid down under section 438(2) of the Cr.P.C.
