JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,504,307 and 379/34 of the Indian Penal Code.
The prosecution case is that the petitioner and others obstructed the mother of the informant from taking water. When the informant made protest then both the accused assaulted the informant and mother of the informant and snatched her ear ring. The accused persons also tried to strangulate the informant by putting rope around his neck.
It is submitted by the learned counsel for the petitioner that the petitioner is agnate of the informant and due to land dispute the accusation has been levelled. The injury of the

It is further submitted that the mother of the informant has not received any injury though statement to that effect has not been made in the petition. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the genesis of the occurrence, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nalanda at Biharsharif in connection with Ben P.S. Case No.25 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
