JUSTICE SUDHIR SINGH ORAL ORDER 13-07-2015 Heard learned counsel for the petitioners and the State. The petitioner is apprehending his arrest in connection with Roh PS case No. 21/2015 for the offence under section 354(B) and 354(D) of the Indian Penal Code.

The prosecution story, in brief, is that the informant was returning to her house after tuition and the petitioner was teasing her repeatedly and when the informant protested the petitioner told that he will marry with her upon which she started weeping and went before Manoj and narrated the said facts and then went to her house and narrated the facts aforesaid. It has been submitted on behalf of the petitioner that the petitioner has been made accused on account of mistake of fact. It has further been submitted that petitioner has committed no

No.24334 of 2015 (2) dt.13-07-2015 2/2 offence as alleged by the informant and, in fact, there is some dispute between petitioner and informant's brother and for the said reason the case has been instituted against him. It has been submitted on behalf of the petitioner that petitioner has got no criminal antecedent.

It has been submitted on behalf of the State that the petitioner is named in the first information report. Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Roh PS case No. 21/2015, subject to condition as laid down under section 438(2) of the Cr. P.C.
