The petitioner seeks regular bail in connection with Kutumba P.S. Case No. 71 of 2014 registered for the offence punishable under Section 395 of the Indian Penal Code. The allegation is regarding unknown accused persons having committed theft in the house of the informant and having taken away various articles and cash amounting to a sum of Rs. 1.5 lacs.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that neither any T.I. Parade has been held nor any recovery has been made from the conscious possession of the petitioner so as to connect the petitioner with the alleged

Lastly, it is submitted that the co-accused person has already been granted bail vide order dated 29.06.2018 passed by a coordinate Bench of this Court in Criminal Misc. No. 37153 of 2018 as also another co-accused person has been granted bail by a coordinate Bench of this Court in Criminal Misc. No. 20469 of 2017. Lastly, it is submitted that the petitioner is languishing in custody since 11.01.2019.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Kutumba Case No. 71 of 2014.
