02-06-2020 Heard learned counsel for the parties through video conferencing.

This relates to grant of bail in Buxar (M) P.S. Case No. 349 of 2019 registered for the offence under Section 394 of the Indian Penal Code.

As per F.I.R., four miscreants looted away Rs. 13,000/- (thirteen thousand), mobile phone etc. on gun point from the petitioner.

It is submitted on behalf of petitioner that petitioner is not named in the F.I.R. His name has come during course of investigation. No recovery has been made from the petitioner. It is further submitted that till date, no T.I.P. has been held and petitioner is in custody since 23-12-2019.

However, learned A.P.P. for the State submits that on

Patna High Court CR. MISC. No.14860 of 2020(3) dt.02-06-2020 2/2 perusal of paragraph - 55 of the case diary, this fact has come that one loaded country-made pistol has been recovered from the possession of petitioner. Learned A.P.P. also submits that petitioner has got criminal antecedent.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The bail application stands rejected.
