With the consent of the parties, the writ application is being disposed of at this stage.

The petitioner claims himself to be an allottee of shop no. 10 Group-B by the Zila Parishad, Vaishali at Hajipur situated at Gola road, Mahuwa Bazar. It is stated that the rent of the shop was being paid by him from the date of allotment till June, 2014 when respondent no.6 forcibly took possession of the shop. Petitioner has not been able to pay the rent thereafter. It is stated that the aforesaid fact has been brought to the notice of the authority. The petitioner

Patna High Court CWJC No.12025 of 2014 dt.02-09-2016 2/2 also filed a criminal complaint in the Court of learned CJM, Vaishali against the illegal act of the private respondent which, according to the petitioner, is pending before the Court.

Mr. Jha, after making submissions at some lengths, states that the petitioner would be satisfied, if he is permitted to file a representation raising the aforesaid grievance before the respondent no.3 (Executive officer, Zila Parishad) or the Deputy Development Commissioner, Vaishali who may be in the overall in-charge of the affairs of the Zila Parishad, who, in turn, be directed to consider the same in accordance with law.

Having heard the parties, the writ application is disposed of permitting the petitioner to make a grievance in this regard before the concerned authority of the respondent -Zila Parishad Vaishali. If any such representation is filed, within three weeks, the respondent concerned shall examine the grievance of the petitioner and take appropriate steps as required of him/them as quickly as possible preferably within 04 weeks therefrom.
