JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-07-2018 Heard the learned counsel for the petitioner and State. The petitioner is in custody in connection with Hajipur Town P.S. Case No. 207 of 2018 for the offence under Section 414 of the Indian Penal Code and Section 25(1-B)A, 26(2) and 35 of the Arms Act and Section 48 and 52 of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent, he has in custody since 02.04.2018. Learned counsel for the petitioner submits no liquor was required from the possession of the petitioner but the money recovered was treated to be detained money as earned from business of liquor.
