2. The petitioner is apprehending arrest in connection with Bheja P.S. Case No.83 of 2025 lodged on 17.06.2025, for the offences punishable under Sections 3/27 of the Arms Act.

3. As per the prosecution, FIR has been lodged against six named accused persons against whom there is allegation that they all involved in threatening by virtue of making viral social media upload keeping gun in their hand.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that the petitioner is not a person whose photograph with gun becomes viral. He further submits that the name of the petitioner has come by virtue of suspicion raised by Sarpunch that he may involve in such gang.

5. Counsel submits that the criminal antecedent of the

Patna High Court CR. MISC. No.15876 of 2026(2) dt.25-03-2026 2/2 petitioner is not clean as there is one criminal case pending against him. He further submits that no offence of Arms Act is made out against the petitioner as he was not seen in the viral photograph.

6. Learned APP for the State opposes the prayer for bail of the petitioner and submits that as per allegation, ingredient of Arms Act is not against the petitioner.

7. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of Chief Judicial Magistrate-II, Jhanjharpur, Madhubani in connection with Bheja P.S. Case No.83 of 2025, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.
