Patna High Court CWJC No.13076 of 2014(3) dt.09-07-2019 2/2 Division, Gaya as respondent No 13.

Heard learned counsel for the petitioner and the respondent-State.

Learned counsel submits that the petitioner would be preferring his appeal under the Bihar Government Servants (Classification, Control & Appeal) Rules, 2005 against the order of the District Panchayat Raj Officer -cum- Establishment Deputy Collector, Jehanabad dated 23.06.2014. Submission is made on objection made by the learned counsel for the respondent-State regarding the existence of alternative remedy. Since objection is raised by the learned State Counsel, this Court would direct that appeal of the petitioner, if filed within four weeks from today, be considered by respondent No 13 on its own merits without raising the issue of delay and be disposed of expeditiously without any undue delay by a reasoned and speaking order in accordance with law. This Court would be pleased if the appeal is disposed of within four weeks from the date of its filing. (Madhuresh Prasad, J) M.E.H./- U
