The present application has been filed for modification of the order dated 26.09.2022 passed in Cr. Misc. No. 69301 of 2021 and one of the conditions at the time of granting bail was that "the bail bond of the petitioner will be accepted only after framing of charge, if not already framed". Learned counsel for the petitioner submits that the matter is still pending at the stage of cognizance and there is no likelihood of framing of charge in near future. A number of coaccused persons have been granted bail by different Co-ordinate Benches and they are enjoying the privilege of bail, whereas the petitioner has been languishing in custody.

Patna High Court CR. MISC. No.19782 of 2023(2) dt.29-03-2023 2/2 Having regard to the submission made on behalf of the petitioner, the condition about acceptance of the bail bond after framing of charge is deleted.

The order dated 26.09.2022 is modified to the extent indicated above.
