JUSTICE SUDHIR SINGH ORAL ORDER 03-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 406, 420 and 120(B) of the Indian Penal Code.

It is alleged by the informant that the petitioner had taken Rs. 60,000/- from him in the pretext of sending his brother Md. Suleman to Saudi Arab and had also assured him for managing a job there but the brother of the informant returned from Saudi Arab due to lack of job. The petitioner promised to return back the entire money but on repeated demand the petitioner did not return the money and misappropriated the money.

On behalf of the petitioner, it has been submitted that the

Prior to the institution of the present case, a case was instituted by the petitioner against the informant side, vide Annexure 2.The present case is out come of Annexure 2. It is further submitted that the petitioner is ready to deposit an amount of Rs. 10,000/- (ten thousand) in the court below, which shall be subject to final disposal of the case. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, it is directed that the petitioner shall deposit an amount of Rs.10,000/- (ten thousand) in the court below, which shall be subject to final disposal of the case.

Let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rajnish Ranjan, learned J.M.,1st class, Darbhanga in connection with Jalley P.S.Case No. 116/2013, subject to the conditions as laid down u/s 438(2) Cr.P.C.
