2. The petitioner seeks bail in connection with Falka P.S. Case No. 171/2024 registered for the offences under Sections 310(4)/ 310(5) of B.N.S. and Sections 25(I-B)a, 26 and 35 of the Arms Act.

3. The prosecution case in nutshell is that the informant on the basis of some secret information reached the SBI CSP Center and apprehended seven persons including the petitioner and certain recoveries were made from all of them.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case on mere suspicion. Learned counsel further submits that

Learned counsel further submits that similarly situated persons have been granted bail by a Co-ordinate Bench of this Court and the order of which forms part of this bail petition and is annexed as Annexure 'P-2'. It is lastly submitted that petitioner has one criminal antecedent and he is languishing in custody since 06.10.2024.

5. Learned counsel for the State has opposed the prayer for bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and taking into account that similarly situated coaccused person has been granted bail by a Co-ordinate Bench of this Court which is annexed as Annexure 'P-2' to this petition, let the petitioner above-named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Katihar in connection with Falka P.S. Case No. 171/2024.
