JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-05-2018 Heard the learned counsel for the petitioners and the learned APP for the State.
The petitioners seek regular bail in connection with Banka PS case no. 311 of 2017 instituted for the offences punishable under Section 379 of Indian Penal Code. The allegation is regarding theft of motorcycle of the informant.
The learned counsel for the petitioners submits that the neither any recovery has been made from the house of the petitioners or from their possession nor any T.I. parade has been conducted till date. It is further submitted that petitioners have been remanded in the present case when they were arrested in another case. It is lastly submitted that the petitioners are languishing
Patna High Court Cr.Misc. No.32269 of 2018 (2) dt.24-05-2018 2/2 in custody since 07.09.2017.
Having regard to the facts and circumstances of the case, the abovenamed petitioners are directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Banka in connection with Banka PS case no. 311 of 2017.
