06-03-2020 Heard learned counsel for the parties.

The petitioner apprehends his arrest in Kochas P.S. Case No. 152 of 2018 registered for the offence under Section 366(A) of the Indian Penal Code.

The F.I.R. relates to kidnapping the daughter of the informant.

It is submitted on behalf of petitioner that petitioner has falsely been implicated in this case and he is father of coaccused Amit Paswan, against whom, there is specific allegation. It is further submitted that the victim girl, in her written application filed before the court below (Annexure -2), has specifically stated that nobody kidnapped her. She had voluntarily gone with Amit Paswan, since there is love affairs in

Patna High Court CR. MISC. No.13724 of 2020(2) dt.06-03-2020 2/2 between them. In the written statement, the victim girl has denied the allegation levelled against petitioner and his son. It is further submitted that co-accused Amit Paswan has already been granted bail by this Court, vide order dated 05-08-2019 passed in Cr. Misc. No. 48517 of 2019 (Annexure - 3). Petitioner has clean antecedent.

Considering the aforesaid facts and circumstances as well as nature of accusation, in the event of his arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Sasaram, Rohtas in connection with Kochas P.S. Case No. 152 of 2018, subject to condition, as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Singh, J.) anay U T
